Rider terms

The short agreement between Wind HQ and you, if you ride. Your consumer rights are untouched by it.
1. Who this is between
This is the agreement between Sergei Fedorov Računarsko Programiranje pr cpp Beograd, a sole trader registered in Belgrade, Serbia, trading as Wind HQ(“we”, “us”), and you, if you use Wind HQ as a rider — that is, as somebody taking lessons at a school that uses it.
If you run a school, the school agreement is yours instead. If you are an instructor, both touch you: this document covers your own account, and your school’s agreement covers the lessons you teach.
2. What Wind HQ does for you
It tells you when your lessons are, what equipment has been set aside for you, and who is teaching you — and when the wind moves your lesson, it asks you to confirm the new time. That is the whole of it. Your school decides everything; we carry the message and keep the record.
3. It is free to you
A rider account is free wherever a school has invited you, and will stay free. If we ever offer a paid rider tier — an account that follows you between schools — it will be something you choose, and no charge will ever arise without you affirmatively accepting a paid plan first. We will not turn a free account into a paid one.
4. Your account
You must be 18 or over to hold one. If you are under 18, your school records your lessons with your parent’s or guardian’s authority and you do not need an account of your own.
Keep your login to yourself and tell us if you think somebody else has it. Give us accurate contact details, because the whole point of the service is being able to reach you when the day changes.
5. Safety belongs to the people on the beach
Kitesurfing is hazardous and the conditions change without warning. Wind HQ shows forecasts and suggests equipment sizes. Those are suggestions to your school, not instructions to you, and not a substitute for the judgement of the instructor standing next to you.
- Forecast data comes from third parties. It can be wrong, late or missing. Never treat it as the sole basis for a decision about going on the water.
- An equipment suggestion is arithmetic on weight and wind. It knows nothing about your ability, the sea state, or how you feel that morning.
- If your instructor says stop, that decision outranks anything on your screen.
Your school is responsible for how it teaches you, for its instructors’ qualifications, for rescue cover and for its insurance. We are responsible for the software.
6. Fair use
Do not use the service to break the law or to harass anybody, do not try to reach another school’s or another rider’s data, and do not attempt to disrupt the service. Telling us about a security flaw in good faith is welcome — see the school agreement’s clause on that, which applies to you equally.
7. Your data
Most of what Wind HQ holds about you was recorded by your school, which is the controller of it; we process it on their instructions. Your own profile is yours. The privacy policy explains all of it, and forms part of these terms.
You can withdraw from a school at any time, and you can delete your account at any time.
8. When it is not working
We try to keep the service running and we do not promise it always will. Parts of it depend on third parties — messaging, voice, weather — and can fail with them. If a message does not reach you, your school is still your school: talk to them.
9. Our responsibility to you
Your consumer rights come first. Nothing in this document takes away a protection the law where you live gives you, and nothing in it limits our liability for death or personal injury caused by our negligence, or for fraud. If you are in Brazil, the Consumer Defence Code applies to this agreement in full.
Beyond that: the service is provided as it is; we are not responsible for a decision your school or your instructor made; and we are not liable for indirect losses such as a missed trip or a lost holiday.
10. Changes, and ending it
You can stop using Wind HQ and delete your account whenever you like. We will tell account holders by email before a material change to these terms takes effect. If we discontinue the service we will give reasonable notice and a way to take your data with you.
11. Law
These terms are governed by the laws of Serbia — but as a consumer you keep the protections and the courts available to you where you live, and this clause does not change that. In practice: if you are in Brazil, you can bring a claim in Brazil under Brazilian consumer law.
